An Act to Make Special Provision in relation to THE TARA SmRE Certain Valuations in the Shire ofTara and to COUNCIL VALUATION AND Validate Certain Matters arising therefrom, VALIDATION ACT OF and for other incidental purposes. 1941. [ASSENTED TO 16TH DECEMBER, 1941.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title. 1. This Act may be cited as " The Tara Shire Council Valuation and Validation Act of 1941." Valuati<;m 2. (1.) Every notice of the valuation adopted by Notice of the Council of the Shire of Tara on the twenty-fourth valuation. day of June, one thousand nine hundred and forty-one, and of the amount thereof, given to the owner of any parcel of land returned in such valuation shall be and be deemed to be and to have always been a notice of such valuation duly given under and for the purposes of *" The Local Government Acts, 1936 to 1941." Any person upon whom such notice was served and who, within twenty-eight days after such notice was received by him, gave to the said Council notice of his intention to appeal against such valuation, may appeal against such valuation. Except as hereinbefore in this. subsection provided no person will have any appeal against the valuation of any rateable land mentioned in subsection three of section five of t" The Local Government Act Amendment Act of 1940 " adopted by the Council of the Shire of Tara on the twenty-fourth day of June, one thousand nine hundred and forty-one. 3. No. 11, 1941. hundred and forty-two, are, and are hereby declared always to have been, rates the making of which by the said Council under *" The Local Government Acts, 1936 to 1941," or any other Act authorising it in that behalf is and always has been valid and lawful, and, subject to this section, the levying by the said Council of any such rate is, and shall be, and is hereby declared always to have been, valid and lawful, and every owner of any rateable land in the said Shire is, and shall be, and is hereby declared always to have been, legally liable to pay every such rate as made and levied in his case, and if he fails so to do the same may be recovered, and is hereby declared always to have been recoverable, by the said Council in any manner provided by law, and it shall be immaterial that the fresh valuation of any rateable land in the said Shire mentioned in subsection three of section five of t" The Local Government Act Amendment Act of 1940" was not made and completed on or before the thirtieth day of June, one thousand nine hundred and forty-one. (2.) Notwithstanding anything hereinbefore contained in subsection one of this section, if the Valuation Court constituted by the Assistant Com- missioner of Land Tax reduces or increases the valuation of any land mentioned in subsection three of section five of t" The Local Government Act Amendment Act of 1940" adopted by the Council of the Shire of Tara on the twenty-fourth day of June, one thousand nine hundred and forty-one, in the case of any appeal permitted by this Act the said Council shall levy the amount of any rate made or purporting to have been made by it for the year ending on the thirtieth day of June, one thousand nine hundred and forty-two, upon the rateable land in question upon the basis of such reduced or increased valuation. Any levy of any rate purporting to have been made upon the basis of the valuation of any land hereinbefore in this subsection mentioned adopted by the said Council on the twenty-fourth day of June, one thousand nine hundred and forty-one, shall, if the valuation adopted on the said date is reduced or increased upon appeal by the Valuation Court constituted by the Assistant Commissioner of Land Tax, be and be deemed to have always been void and of no legal effect whatsoever. * 1 G. 6 No. 1 and amending Acts.
