The applicant seeks special leave to appeal from a decision of the Court of Appeal of the Supreme Court of Victoria (Niall and T Forrest JJA, Macaulay JA dissenting), ordering the lifting of a permanent stay on the applicant's prosecution on a charge of rape contrary to s 38 of the Crimes Act 1958 (Vic) as in force at the time of the alleged offending.
The application for special leave does not disclose any reason that would justify the fragmentation of the criminal process and is an inappropriate vehicle to consider the question of law sought to be raised by the applicant.
Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
