s1 4 s4 TAB Queensland Limited Privatisation Legislation No. 35, 2004 Amendment Act 2004 The Parliament of Queensland enacts— Part 1 Preliminary 1 Short title This Act may be cited as the TAB Queensland Limited Privatisation Legislation Amendment Act 2004 . 2 Commencement (1) Part 2, other than section 5(2), commences on 5 November 2004. (2) Section 5(2) commences on 1 January 2005. Part 2 Amendment of TAB Queensland Limited Privatisation Act 1999 3 Act amended in pt 2 This part amends the TAB Queensland Limited PrivatisationAct 1999 . 4 Replacement of s 43 (Application of pt 5) Section 43— omit, insert ‘43 Application of pt 5 ‘This part applies only to a TABQ group company that is— (a) a licensed monitoring operator under the GamingMachine Act 1991 ; or
s5 5 s6 TAB Queensland Limited Privatisation Legislation No. 35, 2004 Amendment Act 2004 (b) a wagering licensee or a wagering manager under the Wagering Act 1998 .’. 5 Amendment of s 44 (TABQ group companies to have constitutions containing certain provisions) (1) Section 44(2)(b)— omit, insert ‘(b) at least 3 of the directors of the company to be ordinarily resident in Queensland; and (c) the chief executive officer of the company to be ordinarily resident in Queensland; and (d) each annual general meeting of the company to be held in Queensland.’. (2) Section 44(3)(c)— omit, insert ‘(c) in each year, at least 4 of the company’s board meetings are held in Queensland; and (d) each meeting of the company’s board held annually for the purpose of strategic planning is held in Queensland.’. 6 Amendment of s 50 (Pt 5 overrides Corporations Law) Section 50, heading, ‘ Law ’— omit, insert Act ’.
