SZKSH v Minister for Immigration and Citizenship
[2008] HCASL 370
SZKSH
v
MINISTER FOR IMMIGRATION AND CITIZENSHIP & ANOR
[2008] HCASL 370
S143/2008
The applicant is a citizen of the People's Republic of China. On 23 March 2007 the Refugee Review Tribunal upheld a refusal by a delegate of the first respondent to grant a protection visa. It rejected the applicant's claim to fear persecution because of her involvement with Falun Gong, and did not believe numerous details advanced in support of that claim. She lacked knowledge of many things a Falun Gong practitioner of nine years standing would be expected to have. The Tribunal rejected her explanations for this state of affairs.
The Federal Magistrates Court (Turner FM) dismissed an application for judicial review. The Federal Court of Australia (Besanko J) dismissed an appeal. The grounds advanced boil down to an allegation of bias and an allegation of factual error. The first was not made out and the second is immaterial.
The very brief documents filed in support of her application for special leave to appeal to this Court point to no error in the reasoning of the courts below.
The application is dismissed.
Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application for special leave.
