SZJUP v Minister for Immigration and Citizenship
[2008] HCASL 467
SZJUP
v
MINISTER FOR IMMIGRATION AND CITIZENSHIP & ANOR
[2008] HCASL 467
S207/2008
The applicant claims to be a citizen of the People's Republic of China.
The Refugee Review Tribunal accepted that claim, but upheld a decision of a delegate of the first respondent refusing the applicant a protection visa. It did so because the claims made of fearing harm as a Falun Gong adherent lacked essential detail.
The Federal Magistrates Court (Lloyd-Jones FM) refused an application for judicial review. The Federal Court of Australia (Lindgren J) dismissed an appeal.
The essential difficulty facing the applicant is that despite an invitation to do so, he failed to attend the Tribunal hearing. The bases on which he seeks special leave to appeal to this Court do not grapple with that essential difficulty.
The application is dismissed.
Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application for special leave.
