SZIYZ v Minister for Immigration and Citizenship

Case

[2008] HCASL 279

SZIYZ
v
MINISTER FOR IMMIGRATION AND CITIZENSHIP & ANOR
[2008] HCASL 279
S645/2007

  1. The applicant is a citizen of the People's Republic of China.  The Refugee Review Tribunal upheld a decision of the first respondent to refuse her a protection visa.  The Tribunal informed her that it was unable to make a decision in her favour on the strength of the documentary material to hand alone.  It invited her to attend the Tribunal hearing to give oral evidence and present arguments.  She did not attend.  The Tribunal dismissed the application because of the scantiness of the information provided.

  2. The Federal Magistrates Court (Lloyd-Jones FM) dismissed an application for judicial review.  The Federal Court of Australia (Cowdroy J) dismissed an appeal.

  3. The applicant's very brief written case makes a number of untrue allegations against the Tribunal but suggests no reason for thinking that an appeal would have any prospects of success were the special leave application to be granted.

  4. The application is dismissed.

  5. Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application for special leave.
