REASONS FOR JUDGMENT

  1. I have read the affidavit of Mr Andras Markus on behalf of the first respondent and he has handed up a copy of the movement check which indicates that the applicant left this country on 29 March 2007 on the basis of a visa which did not permit her to return.  In the circumstances I dismiss the application.  I order that the applicant pay the respondent’s costs assessed in the sum of $3,750.00.  I also order that the name of the first respondent be amended to Minister for Immigration and Citizenship.
