REASONS FOR JUDGMENT

  1. The applicant in this matter, who did not appear before the Refugee Review Tribunal, did not appear at the time at which this case is set down for hearing, namely 10.15 am on 7 March 2007.  The court file reveals that the applicant attended a callover of his case at 3.15 pm on 3 March 2006 and was aided by a Mandarin interpreter.  The applicant speaks Mandarin.  Although he is a national of South Korea he has lived in China for many years. 

  2. The applicant was not in attendance when his name was called outside the court at 10.33 am and in those circumstances I propose to dismiss his application pursuant to Part 13 Rule 13.03A(c) of the Federal Magistrates Court Rules 2001.  I order that the applicant pay the respondent’s costs which I assess in the sum of $2,800.00.  I also order that the name of the first respondent be changed to the Minister for Immigration and Citizenship.
