SZGIY v Minister for Immigration and Citizenship

The applicants, SZGIY, sought leave to appeal a decision of the Federal Magistrates Court which had rejected their claims for protection and humanitarian visas. The Minister for Immigration and Citizenship opposed the application. The applicants argued that the Federal Magistrates Court had erred in its consideration of the evidence and in its assessment of their credibility. The High Court was required to determine whether the applicants had established that the Federal Magistrates Court had made an error of law that warranted an appeal. The Court considered the arguments presented by both parties and examined the merits of the appeal. The Court found that the applicants had demonstrated that there was a reasonable possibility that the Federal Magistrates Court had erred in law and that the appeal had a real chance of success. The Court also noted that the matter was appropriate for the Full Court and directed that it be referred to the Sydney list judge for allocation of a hearing date. The Court granted the applicants leave to appeal and ordered that the notice of appeal be filed by a certain date. The Court also ordered that the costs of the application for leave to appeal be the costs of the appeal and directed that the appeal hearing be expedited.
