HAYNE J: The applicants seek special leave to appeal against orders of the Federal Court of Australia (Moore J) dismissing an appeal instituted by the applicants and, if leave to appeal was necessary, refusing that leave. The orders the applicants sought to challenge were made by the Federal Magistrates Court (Smith FM) and dismissed their claims to relief in respect of a decision of the Refugee Review Tribunal. The Tribunal decided that it had no jurisdiction to entertain the applicants' application for review of the decision of a delegate of the Minister refusing the applicants protection visas. The Tribunal had previously reviewed that decision and affirmed it and the applicants' claims for judicial review of this earlier decision of the Tribunal had failed at first instance, on appeal and on application for special leave.
There is no reason to doubt the correctness of the decision of Moore J.
Pursuant to r 41.10.5 we direct the Registrar to draw up, sign and seal an order dismissing the application. I publish that disposition.
AT 9.32 AM THE MATTER WAS CONCLUDED
