His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Sydney Water Catchment Management Act 1998.

Explanatory note

The Sydney Water Catchment Management Act 1998 constitutes the Sydney Catchment Authority to manage and protect certain catchment areas and catchment infrastructure works that affect the supply of water. Previously, the management and protection of those areas and works was the sole responsibility of the Sydney Water Corporation and was facilitated by a regulation made under the Sydney Water Act 1994. The object of this Regulation is to make provision for the protection of those areas and works that will now be the responsibility of the Sydney Catchment Authority. The Regulation applies the provisions of the regulation made under the Sydney Water Act 1994 (under which the Sydney Water Corporation is the responsible body) as a regulation under the Sydney Water Catchment Management Act 1998 with the Sydney Catchment Authority as the responsible body.

This Regulation comprises matters of a transitional nature and sunsets at the end
of 30 June 2000.
This Regulation is made under clauses 1, 3 and 4 of Schedule 6 to the Sydney

Water Catchment Management Act 1998.

1         Name of Regulation

This Regulation is the Sydney Water Catchment Management
(Transitional Arrangements) Regulation 1999.

2         Commencement

This Regulation commences on the date of commencement of Part 5 (Catchment areas) of the Sydney Water Catchment Management Act 1998.

3         Definitions

(1) In this Regulation:

amending Regulation means Sydney Water Corporation Limited (Catchment Management) Amendment Regulation 1999.

Sydney Water Regulation means Sydney Water Corporation

Limited (Catchment Management) Regulation 1995.

(2) The explanatory note and table of contents do not form part of
this Regulation.

4         Regulation of conduct on land for which Sydney Catchment Authority is responsible

The Sydney Water Regulation, as in force immediately before its amendment by the amending Regulation, is taken to be a regulation made under the Sydney Water Catchment Management Act 1998, and, as a regulation under that Act, is taken to have been amended as follows:

(a)

by omitting “Sydney Water Corporation Limited (Catchment Management) Regulation 1995” from clause 1 and by inserting instead “Sydney Water Catchment Management (General) Regulation 1999”,

(b)

by omitting “1 September 1995” from clause 2 and by inserting instead “the date of commencement of Part 5 (Catchment areas) of the Sydney Water Catchment Management Act 1998”,

(c)

by omitting “Corporation” wherever occurring and by inserting instead “Authority”,

(d)

by inserting in clause 3 in alphabetical order the following definitions:

Authority means the Sydney Catchment
Authority.
Authority land means land owned by or vested in
the Authority.
controlled area has the same meaning as in the
Act.
special area has the same meaning as in the Act.
the Act means the Sydney Water Catchment

Management Act 1998.

(e) by omitting the definitions of “Corporation”, “Corporation land” and “the Act” from clause 3,
(f) by omitting “the Corporation” wherever occurring and by inserting instead “the Authority”,
(g) by omitting “the Corporation’s” wherever occurring and by inserting instead “the Authority’s”,
(h) by omitting “Corporation land” wherever occurring and by inserting instead “Authority land”.

5 Operation of Sydney Water Corporation Limited (Catchment Management) Regulation 1995 unaffected

This Regulation does not affect the continuing operation of the Sydney Water Regulation as a regulation under the Sydney Water Act 1994.

This Regulation ceases to have effect at the end of 30 June
2000.
