I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 51 of the Sydney Water Catchment Management Act 1998, make the following Order.

Explanatory note

The object of this Order is to declare that certain areas owned by or vested in the Sydney Catchment Authority (constituted by the Sydney Water Catchment Management Act 1998) are controlled areas for the purposes of that Act.

This Order is made under section 51 of that Act.

Sydney Water Catchment Management (Controlled
Areas) Order 1999

1      Name of Order

This Order is the Sydney Water Catchment Management

(Controlled Areas) Order 1999.

2 Commencement

This Order commences on the date of commencement of Part 5 (Catchment areas) of the Sydney Water Catchment Management Act 1998.

3      Controlled areas

(1) This clause applies to land owned by or vested in the Sydney Catchment Authority that contains water transfer structures (being canals, tunnels, pipelines, water mains or drainage channels), including the following water transfer structures:

(a) The Upper Canal,

(b)

Warragamba pipelines (pipelines that transfer water from Warragamba Dam to Prospect Reservoir).

(2)

The areas of land to which this clause applies are declared to be controlled areas for the purposes of section 51 of the Sydney Water Catchment Management Act 1998.
