Sydney Water (Area of Operations) Order

I, the Honourable Margaret Beazley AC QC, Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 10(2) of the Sydney Water Act 1994, make the following Order.

Explanatory note

The object of this Order is to expand Sydney Water Corporation’s area of operations to cover the following areas—

(a)	specified land located in the local government area of the Wingecarribee Shire Council,
(b)	specified land located in the local government area of the Wollondilly Shire Council,
(c)	internal coastal waters such as Botany Bay, Port Hacking and Port Jackson,
(d)	coastal waters in which existing structures, facilities or works (such as the existing ocean outfalls) operated by the Corporation are located,
(e)	any land on which there is located an existing structure, facility or work that is part of a system or service provided by the Corporation,
(f)	an area of up to 100 metres from the perimeter of any existing structure, facility or work referred to in paragraph (d) or (e).

Under section 10(6) of the Sydney Water Act 1994 (the Act), this Order does not take effect until written notice of the Order, and a copy of the Order, is laid before each House of Parliament and either—

(a)	15 sitting days of each House of Parliament has passed after the Order was tabled and a notice of motion to disallow the order has not been given, or
(b)	if a notice of a motion to disallow the Order has been given, the motion has lapsed or has been withdrawn or defeated.

This Order is made under section 10(2) of the Act.

1      Name of Order

This Order is the Sydney Water (Area of Operations) Order 2020.

2      Interpretation

(1) In this Order—

coastal waters of the State has the same meaning as in Part 10 of the Interpretation
Act 1987, and includes the seabed and subsoil beneath those waters.

relevant local government area means any local government area located (or any

part of which is located) in the area of operations of the Corporation.

Note. The Sydney Water Act 1994 and the Interpretation Act 1987 contain definitions and

other provisions that affect the interpretation and application of this Order.

(2) Notes included in this Order do not form part of this Order.

3      Expansion of area of operations of Sydney Water Corporation

The area of operations of the Corporation is expanded to include the following areas—

(a)

the land, located within the local government area of the Wingecarribee Shire Council, specified in Schedule 1,

(b)

the land, located within the local government area of the Wollondilly Shire Council, specified in Schedule 2,

(c)

any part of the coastal waters of the State that—

(i)	is adjacent to a relevant local government area, and
(ii)	is on the landward side of any baseline determined by Proclamation under section 7 of the Seas and Submerged Lands Act 1973 of the Commonwealth,

(d)

any part of the coastal waters of the State—

(i)	that is adjacent to a relevant local government area, and
(ii)	in which (or under which) there is located, as at the commencement of this Order, a structure, facility or work owned or constructed by or on behalf of the Corporation or its predecessors,

(e)

any land on which there is located, as at the commencement of this Order, a structure, facility or work—

(i)	owned or constructed by or on behalf of the Corporation or its predecessors, and
(ii)	that is part of a system or service provided by the Corporation in its area of operations,

(f) any land within 100 metres from the perimeter of any existing structure, facility or work referred to in paragraph (d) or (e).
