No. XXXVII.

An Act to provide for the establishment and

endowment of Colleges within the University

of Sydney. [2nd December, 1854.]

W H E R E A S it is expedient to encourage and assist the establish­ m e n t of Colleges w i th in t he Univers i ty of Sydney in which
Colleges sys temat ic rel igious ins t ruc t ion a n d domestic supervision
wi th efficient assistance in p r epa r ing for t h e Unive r s i ty lectures a n d

examina t ions shall he provided for s tuden t s of t he Univers i ty Be i t therefore enacted by H i s Excel lency t h e Governor of N e w Sou th W a l e s w i th t h e advice and consent of t h e Legislat ive Counci l thereof as follows :—

1. W h e n e v e r any College shal l have been established a n d incor­

pora ted by any A c t of t h e Governor and Council as a College wi th in t h e Univers i ty of Sydney and t h e founders of or subscribers to such College shall have complied w i t h t he condit ions men t ioned in t he nex t section such College shall be ent i t led to t h e endowments hereinaf ter severally men t ioned which said endowment s shal l be pa id by t h e

Treasurer of t he Colony u n d e r w a r r a n t s s igned by the Governor.
2. N o such College a l though incorporated shall be ent i t led to

not less t h a n four thousand pounds shall have been paid and inves ted in such m a n n e r as shal l be approved of by t h e Governor and the residue shall have been to his satisfaction secured to be paid wi th in th ree years nex t following nor unless t h e whole of t h e said t e n thousand pounds shal l be devoted exclusively to t he erect ion of College bui ld­ ings on land g ran ted for t h a t purpose by H e r Majesty to t h e Univers i ty in t r u s t for such College (if any shall be so g ran ted and if no t t hen upon land otherwise conveyed to and accepted by t h e Univers i ty in such t rus t ) a n d i t shall have been agreed by t h e founders t h a t t h e

ent i re a m o u n t shal l be so expended if t h e Univers i ty so requ i re
wi th in live years n e x t after t he first p a y m e n t on account of e i ther of
such endowments .

3. There shall be paid out of t h e Genera l Revenue in aid of the Bu i ld ing F u n d of every College so incorpora ted a s u m or sums not exceeding in t he whole twen ty thousand pounds nor more t h a n shall have been from t i m e to t ime actual ly expended by the College out of its subscribed funds for t h e purpose of bui ld ing.

4.    There shall be paid out of t h e said Genera l R e v e n u e annua l ly

to such incorpora ted College in pe rpe tu i ty a s u m of five hund red pounds for t h e use of a n d as a salary to t h e Pr inc ipa l of such College or in aid of such salary.

5. E v e r y such Pr inc ipa l shall be ent i t led to t he a n n u a l salary

hereby provided for on t h e produc t ion of his own certificate a t t he t i m e of each p a y m e n t t h a t he has du r ing t h e period to which it relates performed the dut ies of his office Provided t h a t he shall t r a n s m i t to t h e Colonial Secretary once in each year a certificate to the l ike effect under t he hands of such persons as shall be for t h a t purpose appoin ted

by t h e cons t i tu t ion or rules of t h e par t icu la r College.
6. W h e r e any person selected to be t he P r inc ipa l of any such

College shall be out of th i s Colony a t t h e t ime of his appo in tmen t no such certificate shall be requi red un t i l after he shal l have ac tua l ly en te red on his dut ies b u t he shal l be ent i t led to t he salary (and the College to which he shal l have been appointed may receive t h e same accordingly for h is use) from t h e day of his embarka t ion for th i s Colony Provided t h a t every Pr inc ipa l shal l actual ly enter on his

dut ies w i th in six m o n t h s after such embarka t ion unless t h e Governor
upon be ing satisfied t h a t unavoidable obstacles have in tervened shall
t h i n k fit to ex tend t h a t t e r m to n ine mon ths .
7. U n t i l t h e subscribed fund shall be requi red for t he erection
of College bui ld ings as aforesaid t h e in teres t or other proceeds accru ing

from t h e inves tment thereof or of t h e por t ion r ema in ing unexpended from t ime to t ime m a y be applied to t h e genera l purposes of t h e College as the govern ing body of such College may determine .

8. Al l s tuden t s in any such College shall immedia te ly upon

en te r ing the re in ma t r i cu l a t e in t h e Univers i ty and shall thereaf ter con t inue to be m e m b e r s thereof and submi t and be subject to the discipline thereof and shall be requi red duly a n d regu la r ly to a t tend the lectures of the Univers i ty on those subjects an examina t ion and proficiency in wh ich are requi red for H o n o r s and Degrees wi th the except ion (if t h o u g h t fit by any such College) of t he lectures on E th ics

9. A n d whereas i t has been resolved by the Senate of the Univers i ty of Sydney t h a t H o n o r s and Degrees shall no t be given to any s tuden t who shal l no t produce tes t imonials of competent religious a t t a i n m e n t s and i t is expedient to give legal pe rmanency to such resolut ion Be i t therefore enacted t h a t no H o n o r or Degree shall be conferred by the Univers i ty on any s tuden t who shall not produce

10. The t e r m Pr inc ipa l shal l inc lude Mas t e r W a r d e n or any

other H e a d of a College.
