I, the Minister for Planning, in pursuance of section 51 of the
Environmental Planning and Assessment Act 1979, make the regional environmental plan set out hereunder.

Citation
1. This plan may be cited as Sydney Regional Environmental Plan No.
17—Kurnell Peninsula (1989)—(Amendment No. 3).
Principal Plan
2. In this plan, Sydney Regional Environmental Plan No. 17—Kurnell
Peninsula (1989) is referred to as the Principal Plan.
Aims, objectives etc.
3. This plan aims to amend the Principal Plan:
| (a) | to redefine the boundary between Zone No. 8 (a) (National Parks |
and Nature Reserves (Existing) Zone) and Zone No. 6 (c) (Private
Recreation Zone); and
| (b) | to introduce definitions for “works associated with or ancillary to oyster farming”, “aid to navigation” and “single mooring”; and |

| (c) | to permit as development allowed with development consent works associated with or ancillary to oyster farming and to permit as development allowed without development consent a single mooring and an aid to navigation in Zone No. 7 (a) (Waterways Zone); and |
(d) to update certain government authority titles.
Land to which plan applies
4. This plan applies to the land to which the Principal Plan applies.
Amendment of Principal Plan
5. The Principal Plan is amended:
| (a) | by inserting in clause 5 (1), in alphabetical order, the following definitions: |
“aid to navigation’’ means a buoy, sign, light or other structure located on a waterway or on land, which is designed to assist the safe and efficient movement of vessels on a waterway;
“single mooring” means an apparatus located on or in a
waterway to which one vessel is attached;
“works associated with or ancillary to oyster farming”
means any structure that is used in the oyster farming industry which relates to the purification, processing or packaging of oysters for wholesale distribution, but which is not used in the direct sale of oysters to the public;
| (b) | by inserting in the definition of “map” in clause 5 (1) after the word “Department” the following words: |
, as amended by the maps (or if any sheets of maps are specified, by the specified sheets of the maps) deposited in the office of the Department and marked as follows:

| (c) | by omitting from paragraph (a) of the definition of “waste disposal” in clause 5 (1) the words “Metropolitan Waste Disposal Authority” and by inserting instead the words “Environment Protection Authority”; |

| (d) | by omitting item 2 of the matter relating to Zone No. 7 (a) (Waterways Zone) in the Table to clause 9 and by inserting instead the following item: |
