provisions as wore declared by or conta ined in the deed of g r a n t the re in recited : A n d whereas in pur suance of such au thor i ty the Crown, by deed dated t he s ix teen th day of December , one thousand e ight hund red and seventy-one, g ran ted t he land the re in described (being the land described in Schedule One to th is Act) to Sir W i l l i a m M o n t a g u M a n n i n g , J o h n Campbel l , A lexande r S tua r t , Chr i s topher Rolleston, and M a t t h e w H e n r y Stephen, the i r heirs and assigns for ever, as t rus tees upon t ru s t for t he Society called t he Sydney Fema le School of I n d u s t r y as theretofore established and t h e n subsis t ing for ever and for no o ther purpose whatsoever, and it was there in provided t h a t t h e said gran tees , t he i r heirs and assigns should no t erect or pe rmi t any bu i ld ing or erection other t h a n a bounda ry Avail or fence to be bui l t w i th in twen ty feet of the inside of the boundary line of the said l a n d : A n d whereas the Crown, by deed dated the th i rd day of September , one thousand e igh t hundred and seventy-four, g ranted the land the re in described (being the land described in Schedule Two to th i s Act) to Sir W i l l i a m M o n t a g u M a n n i n g , J o h n Campbel l ,

Chr is topher Rolleston, and M a t t h e w H e n r y Stephen, and the i r heirs
upon t ru s t as a site for a F e m a l e School of I n d u s t r y : A n d whereas

t he said Sir Wi l l i am M o n t a g u M a n n i n g , J o h n Campbel l , Alexander S tuar t , and Chris topher Rolleston arc since dead, and George Nevil le Griffiths and Alfred Consett S tephen have been duly appoin ted t rus tees of t he lands described in Schedules One and Two aforesaid : A n d whereas the said lands and the bui ld ings thereon are unsui ted to t he purposes of the said t rust , and it is desirable to sell the same and apply t he purchase money for t he purposes hereinaf ter m e n t i o n e d : Be i t therefore enac ted by the K ing ' s Most Exce l l en t Majesty, by and wi th the advice and consent of the Legis la t ive Council and Legislat ive Assembly of N e w South Wales in P a r l i a m e n t assembled, and by the au thor i ty of t he same, as follows :—

1. I t shall be lawful for t he t rus tees for t he t ime being of the Sydney F e m a l e School of I n d u s t r y to sell and absolutely dispose of

the

lands described in the Schedules to this A c t or any pa r t thereof by
publ ic auc t ion or pr iva te cont rac t for such prices as can be obtained
for t he same, and w h e n sold to convey t h e same to any purchasers in
fee-simple, free and discharged from any t rus t s , condit ions, reserva­ tions, and provisions wha t soeve r ; and the receipt in wr i t ing of t h e t rus tees for t he t ime be ing of the said School of I n d u s t r y shal l absolutely discharge the purchasers of t he said lands or of the part thereof from seeing to the appl icat ion of the purchase money for the same, and from all l iabili ty as to the misapplicat ion or non-appl icat ion
thereof.

2. The t rus tees for t he t ime being of t he said School of I n d u s t r y

shall s tand possessed of all moneys ar is ing from any such sale and the income ar is ing from such moneys or any inves tmen t of the same upon

t rus t

t r u s t to apply such moneys and in teres t for t h e purposes of t h e said
School of I n d u s t r y , including 1 , if and when the t rus tees t h i n k fit, t h e

pu rchase or lease of sui table land and bui ldings , a n d t h e erect ion of new bui ld ings , a n d the add ing to or repair of any bui ld ings which m a y be used in connection wi th such School of I n d u s t r y ; and shall invest all or any moneys from t ime to t ime in the i r h a n d s in Gove rnmen t stock or debentures , wi th l iberty to sell, vary, and t ranspose t h e same.

3. U p o n any of t he said t rus tees dying, res ign ing his t rus t , or

becoming incapable , or be ing unwi l l ing to act in the same, the Governor m a y appoin t a t rus tee in the place of t h e t r u s t ee so dying, res igning , or becoming incapable , or be ing unwi l l ing to act in t he t rus t . A n d upon the appo in tmen t of such new t rus tee the land, moneys , and securi t ies for money , subject to t he t rus t , shall t he reupon ves t in t h e

surv iv ing or con t inu ing and the new t rus tees , subject to t h e t rus t s
hereinbefore in this A c t ment ioned .

4. This A c t m a y be cited as the " Sydney F e m a l e School of

I n d u s t r y (Sale) Act , 1901. "

All t h a t piece or parcel of land in our said Colony, con ta in ing by admeasurement one acre two roods and eleven perches, be the same more or less, s i tua ted in t he coun ty of Cumber land , parish of Alexandria , and city of Sydney : Commencing on the south­ eas tern bui lding line of the Dar l inghurs t - r ead at the nor th -wes te rn corner of a g ran t of twen ty -one perches for R o m a n Catholic c h u r c h ; and bounded thence on the nor th­ west by tha t bui lding l ine nor th-eas te r ly six chains eighty-five l inks and one-half of a l i n k ; on the no r th by a l ine dividing i t from the g ran t of one acre for an asylum for des t i tu te females and a measured por t ion of one rood and fourteen perches bear ing south eighty-eight degrees for ty-eight minutes east two chains sixty l inks and one-half of a link to Vic to r i a - s t r ee t ; on the south-east by the bui lding l ine of t ha t s t ree t south­ wester ly seven chains sixty-four l inks and one-quar te r of a link ; and on the south-west by a line dividing i t from a measured port ion of twen ty -n ine perches for Roman Catholic church and the aforesaid twenty-one perches bear ing nor th seventy-two degrees twenty-one minu tes west two chains and twenty-one l inks, to the poin t of commencement .
