SYDNEY ELECTRICITY ACT 1990—REGULATION

(Sydney Electricity (Savings and Transitional) Regulation 1991)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Sydney Electricity Act 1990, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Sydney Electricity (Savings and Transitional) Regulation 1991.

Application of Ordinance No. 54

2. (1) The provisions of Ordinance No. 54 under the Local Government Act 1919 (clauses 11 and 17 excepted) apply to Sydney Electricity and to the Sydney Electricity District in the same way as they apply to a council or county council exercising functions under Part 17 of that Act and to the area of such a council or county council.

(2) In applying the provisions of Ordinance No. 54 to Sydney Electricity and to the Sydney Electricity District, Sydney Electricity is, for the purposes of that Ordinance, to be regarded as a council or county council exercising functions under Part 17 of the Local Government Act 1919.

(3) An offence against the provisions of Ordinance No. 54, as applied by subclause (2), is an offence against this Regulation and is punishable by a penalty not exceeding 5 penalty units.

Cessation of operation of Regulation

3. This Regulation ceases to have effect on 1 July 1991.

EXPLANATORY NOTE

The object of this Regulation is to apply the provisions of Ordinance No. 54 under the Local Government Act 1919 to Sydney Electricity and to the Sydney Electricity District. Ordinance No. 54 contains provisions with respect to the supply of electricity by counciIs and county councils and to the installation and use of electrical appliances by persons to whom electricity is so supplied. The regulation is of a transitional nature only, being intended to have effect, until no later than 1 July 1991, pending the making of a substantive regulation with respect to the same subject-matter.
