SYDNEY ELECTRICITY ACT 1990—REGULATION
(Relating to notices to break up roads etc.)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Sydney Electricity Act 1990, has been pleased to
make the Regulation set forth hereunder.

The Sydney Electricity (Supply) Regulation 1992 is amended by
inserting after clause 20 the following clause:
Notices to statutory bodies in relation to powers to break up roads etc.
20A. The prescribed notices to be given by Sydney Electricity for the purpose of exercising its powers under section 42 (1) of the Act in relation to public roads or public reserves are notices in writing given by Sydney Electricity to the statutory bodies having the control or
management of the public roads or public reserves:
(a)
at least 1 month before Sydney Electricity starts exercising those powers, or such earlier time as may be agreed on by Sydney Electricity and the statutory bodies concerned; or
(b)
in the case of emergencies, as soon as practicable after Sydney Electricity starts exercising those powers.

EXPLANATORY NOTE
The object of this Regulation is to amend the Sydney Electricity (Supply) Regulation 1992 to provide that Sydney Electricity is to give at least 1 month’s written notice (except in the case of emergencies or if another period is agreed on with the statutory body concerned) to the statutory body controlling or managing a public road or reserve in respect of which Sydney Electricity is to exercise certain powers (such as breaking up the road and placing structures and erecting electric lines on or over the road or reserve).
This Regulation is made under the Sydney Electricity Act 1990, including
section 42.
