His Excellency the Governor, with the advice of the Executive Council, has made the following By-law under the Sydney Cricket Ground and Sports

Explanatory note

The object of this By-law is to provide for the banning for 12 months from the Sydney Cricket Ground and the Sydney Football Stadium of persons who enter or remain on the playing fields without authority, or who commit other offences within those grounds, and who are subsequently removed from them. Subsequent offences, or contravention of the ban, will result in a life ban.

This By-law is made under the Sydney Cricket Ground and Sports Ground

Act 1978, including section 29.

  1. Name of By-law

    This By-law is the Sydney Cricket Ground and Sydney Football

    Stadium Amendment (Offenders) By-law 1997.

  2. Commencement

    This By-law commences on 17 January 1997*.

  3. Amendment of Sydney Cricket Ground and Sydney Football Stadium By-law 1994

    The Sydney Cricket Ground and Sydney Football Stadium By-law
    1994 is amended as set out in Schedule 1.

  4. Notes

    The explanatory note does not form part of this By-law.

*The by-law (statutory rule) appointed 17 January 1997 as the date of its commencement.

Pursuant to section 39 (2A) of the Interpretation Act 1987, the by-law is not invalid merely because the by-law was published in the Gazette after the day on which one or more of its provisions is or are expressed to take effect, but provides, in that case, for that or those provisions to take effect from the day on which the by-law is published in the Gazette, instead of from the earlier day.

Schedule 1 Amendments

(Clause 3)

[1]        Clause 4 Entry to Ground

Insert after clause 4 (4):

(5) Despite subclause (l), a person who is banned under this Part from entering the Ground must not enter or be admitted to any part of the Ground during the period of the ban.

[2]       Clause 15A

Insert after clause 15:

15A Banning from Ground

(1) A person who is remo ved under this Part from a pl aying field within the the Ground, or from any other part of the Ground, as a result of contravening clause 14 is banned under this Part from entering the Ground for a period of 12 months commencing on the day the person is so removed.
(2) A person who is so banned from entering the Ground under subclause (1) and who is found on any part of the Ground during the period of the ban is banned under this Part from entering the Ground for life.
(3) A person who has been banned from entering the Ground under subclause (1) and who is at any subsequent time removed under this Part from the Ground as a result of contravening clause 14 is banned under this Part from entering the Ground for life.
