An Act to provide for the payment out to the municipal council of Sydney of certain re sumption moneys and interest standing in the Equi ty Court to the credit of a certain account ; and to provide for the application
of the said moneys and interest, and to
amend and enlarge the powers of the said council in relation there to ; and for other

of Sydney (hereinafter called the council) to the Supreme Court in itsequitable
purposes. [16th November, 1906.]
BE
it enacted by the King's Most Excellent Majesty, by and with. the advice and consent of the Legislative Council and Legislative
Assembly of New South Wales in Parliament assembled, and by the
authority of the same, as follows:—1. This Act may be cited as the " Sydney Council (Resumption
Moneys) Act, 1906 . "
equitable jurisdiction, the said court shall order the payment out to the council of the principal resumption moneys and interest standing in the said court to the credit of the account entitled "Number one thousand eight hundred and forty-live, of one thousand nine hundred and five, ex parte the Minister for Public Works for the State of New South Wales, in the matter of the Lands for Public Purposes Acquisition A c t ; in the matter of the Public Works Act, 1888 ; in the matter of the Darling Harbour Wharves Resumption Act, 1900 ; and in the matter of the Public Works Act, 1900 ; and in the matter
of certain lands situate at Market-street, Lime-street, and Kent-street
North, Darling Harbour, which have been resumed by the Minister
for Public Works aforesaid ; and in the matter of the claims of the
municipal council of Sydney"; and the same shall be paid out
accordingly.
3. The said principal resumption moneys and interest when so
paid out shall be dealt with, disposed of, and applied by the council
in manner following, that is to say :—
(a) A sum of thirteen thousand three hundred pounds, portion of the said moneys, shall be paid to the credit and deemed to
form part of the " electric light account " mentioned in the thirteenth section of the Municipal Council of Sydney Electric Lighting Act, and shall he chargeable in like manner as moneys received in pursuance of the said Act arc chargeable under the said section.
(b)
The balance of the said moneys and interest shall be paid to the credit and deemed to form part of the "c i ty fund" mentioned in the one hundred and ninetieth section of the Sydney Corporation Act, 1902, and shall be applicable to and may be used by the council for all or any of the purposes to and for which the said city fund may, under the said Act, be applied and used.
