monly k n o w n as t he Sydney Common cer ta in sums of money the re in specified and to sell por t ion of t he said land described in t he Schedule to t h e said A c t for t h e purpose of pay ing off t h e deben tures so au thor ized to be issued A n d whereas t he said Mayor A lde rmen and Citizens have borrowed the s u m of five t housand pounds by the sale of deben­ tu re s as by t h e said Ac t is au thor ized and have cont rac ted to sell por t ions of t he l and described in t h e said Schedule A n d whereas
doubts a re en te r t a ined w h e t h e r u n d e r t h e provisions of t h e said Ac t
t h e said M a y o r A lde rmen and Citizens have power to sell t h e l and
described in t h e said Schedule to t h e said A c t except for t he purpose of pay ing off t h e deben tures so author ized to be issued at the t ime when such debentures a re payable A n d whereas it is expedient t o ratify confirm and m a k e valid such cont rac ts of sale as aforesaid and also to enable the said M a y o r A lde rmen and Citizens to borrow a fur ther s u m of money and to sell t he por t ion of l and described in t h e Schedule to t h e said A c t which is now unsold for t h e purpose of improv ing t h e r ema in ing por t ions thereof Be it therefore enac ted
by t h e Queen ' s Mos t Exce l l en t Majesty by and wi th the advice and
consent of t h e Legis la t ive Council and Legislat ive Assembly of N e w
Sou th W a l e s in P a r l i a m e n t assembled and by t h e au thor i ty of t he
same as follows :—
by the Sydney Common I m p r o v e m e n t Act t h e Mayor

1 . All con t rac t s of sale of any por t ion of the land described in

t h e Schedule to t h e said hereinbefore reci ted Act made; by or on behalf of the M a y o r A l d e r m e n and Citizens of t h e City of Sydney shall be as good and valid to all in ten t s and purposes as if t h e same had been m a d e by t h e said Mayor A l d e r m e n and Citizens u n d e r t h e

provisions of th i s Ac t .
2. I t shall lie lawful for t h e M a y o r A lde rmen and Citizens of

the City of Sydney to borrow by t h e sale of debentures a t a r a t e not exceeding six pounds pe r c e n t u m per a n n u m fur ther sums not exceeding t en t h o u s a n d pounds for fur ther improv ing t he said Sydney Common and to sell and convey a t such t ime as shall appear to t h e m

mos t advan tageous t h e por t ion of t h e said l and described in the
Schedule to t h e said reci ted A c t which is no t sold or cont rac ted to be sold as in t h e last p reced ing section ment ioned for t he purpose of improv ing t he r ema in ing por t ion of t h e said l and a n d all conveyances of t he said l and sold or hereafter to be sold shall be in t h e form in the Schedule A.

3 . Receip ts for purchase money given by the M a y o r A l d e r m e n

and Cit izens of t he City of Sydney shall be sufficient d ischarges to

t h e purchase r s of land the sale of which is hereby val ida ted or au thor ized and the said purchasers shal l no t be bound to see to t h e appl icat ion of such purchase money .

4. This Act m a y be cited as t he " Sydney C o m m o n I m p r o v e ­
m e n t Act A m e n d m e n t A c t . "

This Inden ture made the day one thousand eight hundred
and sixty between the Municipal Council of Sydney in the Colony of New South Wales
of the one part and of of the other part witnesseth
tha t the said Council in consideration of the sum of sterling paid to them

which they hereby acknowledge sell and enfeoff to the said his (or her) heirs and assigns (or their successors as the case may be) for ever all tha t parcel of land described in the Schedule hereunder writ ten.

SCHEDULE.

I n witness whereof the said parties have hereunto set their hands and seals the day

and year first above wri t ten.

The common seal of the Mayor Aldermen and Citizens

of the City of Sydney was affixed hereto by me
