17 Qllrrnslan^ ANNO OCTODECIMO ELIZABETHAE SECUNDAE REGINAE No. 5 of 1969 An Act to Amend The Swine Compensation Fund Acts 1962 to 1965 in certain particulars [ASSENTED TO 27TH OCTOBER, 1969] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Swine Compensation Fund Act Amendment Act 1969. (2) The Swine Compensation Fund Act of 1962 as subsequently amended is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Swine Compensation Fund Act 1962-1969. 2. New s. 15A. The Principal Act is amended by inserting after section 15 the following section:- "15A. Power of Governor in Council to exempt from Act. (1) Where the Governor in Council is of opinion that the moneys available in the fund are adequate to meet the purposes for which the fund may be applied that are like!y to arise during any period, the Governor in Council may. from time to time, by Order in Council declare that the provisions of sections 14 and 15 of this Act do not apply in relation to sales of pigs made during the period specified in the Order in Council.
18 Swine Compensation Fund Act Amendment Act 1969, No. 5 (2) Sections 14 and 15 of this Act do not apply in relation to any sale of a pig or pigs that is made during the period specified in a declaration under subsection (1) of this section and whilst the declaration remains in force and accordingly the owner, the agent of the owner and the purchaser of a pig or pigs the subject of such a sale is not required to comply with the provisions of section 15 of this Act with respect to a statement to which that section relates and any such statement made in relation to such a sale is not chargeable with swine sales duty under section 14 of this Act. (3) An Order in Council made under this section may be varied or revoked at any time. (4) Whilst a declaration made pursuant to subsection (1) of this section remains in force, the Minister, or a person authorized by him, may accept the surrender of any swine sales duty stamps that have not been used or cancelled and may pay to the person surrendering the stamps the value thereof. (5) Any payment made pursuant to subsection (4) of this section shall be deemed to be a cost directly connected with the administration of the Act and may be paid from the fund accordingly."
