Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Swimming Pools Act 1992.

Explanatory note
The object of this Regulation is to amend the Swimming Pools Regulation 2008 to:

(a) prescribe each category of accreditation under the Building Professionals Act 2005 that authorises the carrying out of inspections under the Swimming Pools Act 1992 (the Act) as an alternative qualification for accredited certifiers under Division 5 of Part 2 of the Act, and
(b) prescribe accredited certifiers within the meaning of Division 5 of Part 2 of the Act as authorised persons who may access the Register of Swimming Pools.

This Regulation is made under the Swimming Pools Act 1992, including paragraph (b) of the definition of accredited certifier in section 22A, section 30E (6) (b) and section 38 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Swimming Pools Amendment Regulation 2014.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Swimming Pools Regulation 2008

(1) Clause 18E

Insert after clause 18D:

18E Authorised persons who may access Register

Accredited certifiers within the meaning of Division 5 of Part 2 of the Act are prescribed as authorised persons for the purposes of section 30E of the Act.

Note. Section 22A of the Act defines accredited certifier in Division 5 of Part 2 of the Act as an accredited certifier within the meaning of the Building Professionals Act 2005 holding:

(a) category A1, category A2 or category A3 accreditation under that Act, or
(b) if the regulations prescribe alternative qualifications, those alternative qualifications.

Clause 18F prescribes each category of accreditation under the Building Professionals Act 2005 that authorises the carrying out of inspections under the Swimming Pools Act 1992 as an alternative qualification for the purposes of paragraph (b) of the definition of accredited certifier in section 22A of the Act.

18F Alternative qualification for accredited certifiers

Each category of accreditation under the Building Professionals Act 2005 that authorises the carrying out of inspections under the Swimming Pools Act 1992 is prescribed as an alternative qualification for the purposes of paragraph (b) of the definition of accredited certifier in section 22A of the Act.
