No. 12 of 1955.

AN ACT to Facilitate Re-subdivision of Certain

Land for purposes of the State Housing Act, 1946.

[Assented to 1st November, 1955.1

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent of

the Legislative Council and Legislative Assembly of

Western Australia, in this present Parliament

assembled, and by the authority of the same,

as follows:—

1.   This Act may be cited as the Swan Lands Short tins.

Revestment Act, 1955.

"Commission" means The State Housinp- Com- mission constituted under the State Housing Act. 1946:

"land" means the land delineated on Lands and Surveys Department Original Plan No. 6554 and thereon designated as Swan Locations 5589 and 5590, which land, with the excep- tion of the land comprising the portions of the roads and the portions of the drain reserves described in the Schedule, is vested in fee simple in the Commission;

"Schedule" means the Schedule to this Act.

for the purposes of the State Housing Act, 1946,

(a) the portions

(i)   of the roads; and

(ii)    of the drain reserves;

described in the Schedule are closed and

extinguished;

(b)

rights of way over those portions of the roads, and rights of drainage over those portions of the drain reserves, are abolished;

(c) the land, together with all rights to mines of coal and other minerals, if any, under the land,

(i)    is revested in Her Majesty as of her former estate freed and discharged from estates, rights, titles, interests, claims, and demands, if any, of all persons; and

(ii)    on so revesting, is, by operation of this Act, removed from the operation of the Transfer of Land Act, 1893, and becomes Crown land according to the interpretation given to that expres- sion by section three of the Land Act, 1933;

and

(d)

when the land is so revested the Governor may grant to the Commission the fee simple

FRENCH STREET (including truncations) from the south- eastern alignment of Maidos Street to the north-western alignment of Hardy Road (Land Titles Office Plans 3767, 3838 and 4982).

KITCHENER ROAD (including truncations) from the pro- longation north-easterly of the south-eastern boundary of lot 838 on Land Titles Office Plan 3838 to the north- western alignment of Hardy Road (Land Titles Office Plans 3767, 3838, 4982 and 5000).

MONS STREET (including truncations) from the south- eastern alignment of Bayswater Road to the north- western alignment of Colwyn Road (Land Titles Office Plans 3838, 4999 and 5000).

MARGARET STREET (including truncations) from the south-eastern alignment of Colwyn Road to the north- western alignment of Dorothy Street (Land Titles Office Plans 4999 and 5000).

MAIDOS STREET (including truncation) from the north- eastern alignment of Kitchener Road to the south- western alignment of Fisher Street (Land Titles Office Plan 3838).

COLWYN STREET (including truncations) from the north- eastern alignment of Pearson Street to the south- western alignment of Fisher Street (Land Titles Office Plans 3767, 3838, 4982, 4999 and 5000).

JACQUELINE STREET (including truncations) from the north-eastern alignment of Pearson Street to the south- western alignment of French Street (Land Titles Office Plan 4982).

DOROTHY STREET (including truncations) from the north- eastern alignment of French Street to the south- western alignment of Fisher Street (Land Titles Office Plans 4982, 4999 and 5000).

MALEY STREET (including truncations) from the north-

eastern alignment of French Street to the north-western

alignment of Hardy Road (Land Titles Office Plan 4982).

Drain Reserves.

All those portions of drain reserves as follows:—

(i)    That situate between lots 542 and 543 on Land Titles Office Plan 4982.

(ii)    Those running along the north-eastern boun- daries of Swan Locations 4486, 4491, 4500 and 4505 (formerly lots 609, 614, 623 and 628 respec- tively on Land Titles Office Plan 4982).

(iii)    All those delineated and coloured green on Land Titles Office Diagram 6229, save and except that running along the south-eastern boundaries of lots 765 to 774 inclusive from French Street to Kitchener Road.
