[1] Further to proceedings on 22 January 2009, I have received the following correspondence dated 25 January 2010 from Leana Street Consulting Pty Ltd concerning these applications:
These matters were previously set down for mention on Monday 18th January 2010 [sic] at which point Commissioner McKenna raised concerns about the applications.
These matters were subsequently set down for hearing on Thursday 28th January 2010.
We advise that our client has instructed us to withdraw these applications pursuant to s185 of the Fair Work Act 2009 (Cth).
Accordingly we respectfully request that these matters, listed for hearing on Thursday 28th January 2010 be vacated from the list
Our client will re consider their position in light of the fact these applications have been withdrawn
[2] In the circumstances, the hearing has been vacated and I note the applications have been withdrawn.
[3] The proceedings are concluded accordingly.
