Sustainable Planning Amendment Regulation (No. 6) 2011 [s 1] 1 Short title This regulation may be cited as the Sustainable Planning Amendment Regulation (No. 6) 2011 . 2 Regulation amended This regulation amends the Sustainable Planning Regulation 2009 . 3 Insertion of new s 4A After section 4— insert — ‘4A Prescribed day for particular State planning policies to end—Act, s 45 ‘For section 45(2) of the Act, the prescribed day for the following State planning policies to end is— (a) for ‘State planning policy 1/02—Development in the vicinity of certain airports and aviation facilities’—3 August 2013; (b) for ‘State planning policy 2/02—Planning and managing development involving acid sulfate soils’—18 November 2014.’. 4 Replacement of s 27 (Guideline for priority infrastructure plans—Act, s 627) Section 27— omit, insert — ‘27 Guidelines for priority infrastructure plans—Act, s 627 ‘(1) The guideline for preparing priority infrastructure plans is contained in the document called ‘Statutory guideline 01/11—Priority infrastructure plans’, dated 7 November 2011 and published by the department. ‘(2) The guideline for making or amending priority infrastructure plans is contained in the document called ‘Statutory guideline Page 2 2011 SL No. 252

Sustainable Planning Amendment Regulation (No. 6) 2011 [s 5] 02/09—Making and amending local planning instruments’, dated 12 July 2011 and published by the department.’. 5 Amendment of sch 7 (Referral agencies and their jurisdictions) Schedule 7, table 2, after item 15— insert — ‘15A Operational work that is tidal work made assessable under schedule 3, part 1, table 4, item 5 The chief executive administering the TransportOperations (MarinePollution) Act1995 —as a concurrence agency The purposes of the TransportOperations (MarinePollution) Act1995 ’. 6 Amendment of sch 24 (Clearing of native vegetation—not assessable development under schedule 3, part 1, table 4, item 1) Schedule 24, part 1, section 1— insert — ‘(15) Clearing vegetation on land mentioned in the ForestryAct1959 , section 55(1)(b), (c) or (d) to the extent the clearing is for accessing and extracting quarry material for road works under the Transport Infrastructure Act 1994 .’.
