Sustainable Planning Amendment Regulation (No. 4) 2013 [s 1] 1 Short title This regulation may be cited as the Sustainable Planning Amendment Regulation (No. 4) 2013 . 2 Regulation amended This regulation amends the Sustainable Planning Regulation 2009. 3 Amendment of sch 13A (Excluded matters for SCL or potential SCL concurrence agency jurisdiction) (1) Schedule 13A, item 1— insert aquaculture (2) Schedule 13A— insert 8 community infrastructure mentioned in schedule 2 9 a saleyard 4 Amendment of sch 24 (Clearing of native vegetation—not assessable development under schedule 3, part 1, table 4, item 1) (1) Schedule 24, part 1, item 1(8)— omit , insert (8) Clearing vegetation, for an airport-related purpose, on airport premises. (2) Schedule 24, part 1, item 1— insert (16) Clearing vegetation for community infrastructure mentioned in schedule 2. Page 2 2013 SL No. 151
Sustainable Planning Amendment Regulation (No. 4) 2013 [s 5] (3) Schedule 24, part 2, item 2(k)— omit . 5 Amendment of sch 26 (Dictionary) Schedule 26— insert airport premises means premises used, or intended to be used, completely or partly for an airport-related purpose. airport-related purpose , in relation to the use or intended use of airport premises, means any of the following— (a) the construction, operation or maintenance of an airport, including— (i) air transport infrastructure mentioned in schedule 2, part 1; or (ii) core airport infrastructure located on airport land; (b) an activity or facility supporting the economical, efficient and safe functioning of an airport; Examples for paragraph (b) manufacturing aircraft or aircraft components servicing aircraft (c) an activity or facility supporting the financial viability of an airport; Examples for paragraph (c) operating an air charter business or an air freight depot operating a flight training or skydiving business (d) for premises on airport land—development consistent with a land use plan approved for the airport land under the Airport Assets 2013 SL No. 151 Page 3
Sustainable Planning Amendment Regulation (No. 4) 2013 [s 5] (Restructuring and Disposal) Act 2008 , chapter 3, part 1. livestock means alpacas, buffalo, camels, cattle, deer, emus, goats, horses, ostriches, pigs, poultry or sheep. saleyard means premises used for the sale, or offering for sale, of livestock, including any part of the premises used for— (a) temporarily holding livestock before or after the livestock is sold or offered for sale; or (b) transporting livestock to or from the premises; or (c) another activity associated with the sale, offering for sale, temporary holding or transportation of livestock.
