Sustainable Planning Amendment Regulation (No. 3) 2011 [s 1] 1 Short title This regulation may be cited as the Sustainable Planning Amendment Regulation (No. 3) 2011 . 2 Commencement This regulation commences on 25 May 2011. 3 Regulation amended This regulation amends the Sustainable Planning Regulation 2009 . 4 Amendment of sch 1 (Designated regions) Schedule 1, part 8, heading, ‘Whitsunday, Hinterland and Mackay’— omit, insert — ‘ Mackay, Isaac and Whitsunday ’. 5 Amendment of sch 7 (Referral agencies and their jurisdictions) (1) Schedule 7, table 2, after item 40A, under the heading ‘Regional plans’— insert— ‘40B Reconfiguring a lot to which division 3 of the State planning regulatory provisions for the Mackay, Isaac and Whitsunday region applies The chief executive administering the Act—as a concurrence agency The State planning regulatory provisions for the Mackay, Isaac and Whitsunday region’. (2) Schedule 7, table 3, after item 13A, under the heading ‘Regional plans’— Page 2 2011 SL No. 66

Sustainable Planning Amendment Regulation (No. 3) 2011 [s 6] insert— ‘13B A material change of use to which division 2 of the State planning regulatory provisions for the Mackay, Isaac and Whitsunday region applies The chief executive administering the Act—as a concurrence agency The State planning regulatory provisions for the Mackay, Isaac and Whitsunday region’. 6 Amendment of sch 18 (Compliance assessment of particular development) Schedule 18, table 1, item 1, column 2, paragraph (m)— omit, insert— ‘(m) division 3 of the State planning regulatory provisions for the SEQ region, the Far North Queensland region, the Wide Bay Burnett region or the Mackay, Isaac and Whitsunday region applies to the land; or’.
