Sustainable Planning Amendment Regulation (No. 1) 2010 [s 1] 1 Short title This regulation may be cited as the Sustainable Planning Amendment Regulation (No. 1) 2010 . 2 Regulation amended This regulation amends the Sustainable Planning Regulation 2009. 3 Amendment of sch 4 (Development that can not be declared to be development of a particular type—Act, section 232(2)) (1) Schedule 4, table 5, item 11(1)(d)— insert— ‘(iv) any trade training centre is located at least 20m from the boundary;’. (2) Schedule 4, table 5, item 11(1)(g), ‘or multipurpose hall’— omit, insert— ‘, multipurpose hall or trade training centre’. (3) Schedule 4, table 5, item 11(1)— insert— ‘(ga) for a facility that is a trade training centre, the facility is designed and constructed using appropriate measures to ensure noise associated with the use of the facility does not exceed 5db(A) above the background level of noise measured— (i) between 7a.m. and 7p.m.; and (ii) at the boundary of the campus nearest to the facility; Examples of appropriate measures — construction materials designed to reduce noise, building orientation, noise barriers’. (5) Schedule 4, table 5, item 12, editor’s note, ‘25 November 2009’— omit, insert— ‘16 April 2010’. 4 Amendment of sch 26 (Dictionary) (1) Schedule 26— insert— ‘ background level , of noise for schedule 4, table 5, item 11(1)(ga), means the background level of noise measured by applying the relevant procedure under— (a) AS 1055-1997 ‘Acoustics—Description and measurement of environmental noise’; or (b) the document called ‘Noise measurement manual’, published by the department administering the Environmental Protection Act. trade training centre means a facility used for trade or vocational education and training.’. (2) Schedule 26, definition relevant program , paragraph (a), after ‘schools’— insert— ‘, including, for example, trade training centres’.
