529 ANNO VICESIMO SEPTIMO ELIZABETHAE SECUNDAE REGINAE No. 69 of 1978 An Act to amend the Surveyors Act 1977-1978 in certain particulars [ASSENTED TO 8TH DECEMBER, 1978] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Surveyors Act Amendment Act 1978 (No. 2). (2) In this Act the SurveyorsAct1977-1978 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Surveyors Act1977-1978.
5 30 Surveyors Act Amendment Act1978, No. 69 2. Amendment of s. 40 . Section 40 of the Principal Act is amended by- (a) numbering the existing section as subsection (1) and therein- (i) inserting after the words " surveyors or " the words " their registration may be endorsed as "; (ii) inserting after the words "case may be," the words "its registration to be endorsed as "; (b) inserting after subsection (1) as so numbered and amended the following subsections:- " (2) The regulations may prescribe as a condition precedent for the registration of a body corporate as a surveyor or the endorsement as a licensed surveyor of its registration that there be furnished to the Board such indemnity insurance policy, bond or other security as a financial guarantee in such form as is prescribed and in such amount as is fixed by or pursuant to the regulations for the proper performance by the body corporate of the functions and duties of a surveyor or, as the case may be, a licensed surveyor. (3) The regulations may authorize the Board to fix (either generally or in a particular case) an amount of indemnity insurance, bond or other security required by subsection (2) to be furnished either in lieu of any such amount prescribed by the regulations or in the absence of the prescription of any such amount by the regulations."
