SURVEYORS ACT 1929 - REGULATION

(Relating to roads, permanent marks and survey pegs)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Surveyors Act 1929, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 14 September 1990.

Amendments

2. The Survey Practice Regulation 1990 is amended:

by omitting from the definition of ''road" in clause 4 (1) the matter "(in this definition, "established", in relation to a permanent mark shown in the subject survey, has the meaning given to it in the Survey Co-ordination Act 1949)";

by omitting from clause 33 (4) (a) the words “in the Survey Co-ordination Regulations 1951 "and by inserting instead the words "by the regulations made under the Survey Co-ordination Act 1949";

subclause:

by omitting clause 42 (3) and by inserting instead the following

(3) In surveys of lots of:

(a)

4000 square metres or more, all pegs must be of sound durable hardwood or white cypress pine at least 530 mm long and not less than 75 mm by 75 mm nominal section at the top end; or

(b)

less than 4000 square metres, all pegs must be of sound durable hardwood or white cypress pine at least 350 mm long and not less than 75 mm by 35 mm nominal section at the top end.

EXPLANATORY NOTE

The object of this Regulation is to amend the Survey Practice Regulation 1990

made under the Surveyors Act 1929 so as:

(a) to delete unnecessary matter from the definition of "road"; and
(b) to replace the reference to the Survey Co-ordination Regulations 1951 with

a reference to the regulations made under the Survey Co-ordination Act

1949; and

(c) to make provision for the marking with pegs of lots of any size. Currently, the Regulation makes provision only for the marking of lots of 4000 square

metres or more.
