Surveillance Devices Amendment Regulations 2013
The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Surveillance Devices Regulations 2006 to reflect the transfer of the powers and functions of the Office of Police Integrity and the Director, Police Integrity under the Surveillance Devices Act 1999 to the Independent Broad-based Anti-corruption Commission and the Commissioner by the Independent Broad-based Anti-corruption Commission Amendment (Investigative Functions) Act 2012.
2Authorising provision
These Regulations are made under section 37A(1) of the Surveillance Devices Act 1999.
3Commencement
(1)These Regulations (except regulation 8) come into operation on 10 February 2013.
(2)Regulation 8 comes into operation on the day on which Part 8 of the Integrity and Accountability Legislation Amendment Act 2012 comes into operation.
4Principal Regulations
In these Regulations, the Surveillance Devices Regulations 2006[1] are called the Principal Regulations.
5Regulation 4 substituted
For regulation 4 of the Principal Regulations substitute—
4Definitions"
In these Regulations—
Chief Executive Officer means the person appointed under section 27 of the Independent Broad-based Anti-corruption Commission Act 2011;
Deputy Commissioner has the same meaning as it has in the Independent Broad-based Anti-corruption Commission Act 2011;
IBAC Officer has the same meaning as it has in the Independent Broad-based Anti-corruption Commission Act 2011.".
6Regulation 6 substituted
For regulation 6 of the Principal Regulations substitute—
6Prescribed IBAC Officers"
For the purposes of the definition of prescribed IBAC Officer in section 3(1) of the Surveillance Devices Act 1999, the following positions and classes of employees are prescribed—
(a)the position of Commissioner;
(b)the position of Deputy Commissioner;
(c)the position of Chief Executive Officer;
(d)IBAC Officers classified as Executive Officers;
(e)IBAC Officers classified as non-executive employees Grade 4, 5 or 6 or as Senior Technical Specialists.".
7Regulation 8 substituted
For regulation 8 of the Principal Regulations substitute—
8Senior officers of the IBAC"
For the purposes of paragraph (da)(ii) of the definition of senior officer in section 3(1) of the Surveillance Devices Act 1999, the following positions and classes of employees are prescribed—
(a)the position of Deputy Commissioner;
(b)the position of Chief Executive Officer;
(c)IBAC Officers classified as Executive Officers.".
8Renumbering
In regulation 4 of the Principal Regulations, in the definition of Chief Executive Officer, for "section 27" substitute "section 33".
