Surveillance Devices Amendment
Regulations 2007
Made by the Governor in Executive Council.
1. Citation
These regulations are the Surveillance Devices Amendment
Regulations 2007.2. Commencement
These regulations come into operation as follows:
(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette (“Gazettal day”); (b) the rest of the regulations — on the day after Gazettal day. 3. The regulations amended
The amendments in these regulations are to the Surveillance
Devices Regulations 1999.4. Regulation 6 amended
Regulation 6(1) is amended as follows:
(a) after paragraph (d) by deleting “or”; (b) by deleting paragraph (e) and inserting instead — “
(e) for the purposes of any of the following — (i) Bail Act 1982 section 50L(1)(a);
(ii) Sentence Administration Act 2003
section 30(c) or (e)(i) or 57(2)(a);(iii) Sentencing Act 1995 section 33H(2)(b), 75(2)(b) or 84C(2)(b);
(iv) Young Offenders Act 1994
section 109B(1)(a) or 136B(1)(a).

(1) Regulation 7(1) and (2) are amended by inserting before “and
the Australian” —“ , a designated Commission ”. (2) Regulation 7(3) is amended in the definition of “Part 5 record”
by inserting before “or the Australian” —“ , a designated Commission ”. 6. Regulation 8A inserted
After regulation 8 the following regulation is inserted —
“
8A. Reports by designated Commission The information relating to applications for warrants,
extensions of warrants and emergency authorisations
included in a report under section 43A of the Act may
include information of the kind described in
regulation 8.
”.
7. Schedule 1 amended
Each of the Forms in Schedule 1 is amended by inserting after
“❑ Officer of the Corruption and Crime Commission” in each
place where it occurs —“ ❑ Officer of a designated Commission ”.
