Surveillance Devices Amendment (Body-worn Cameras and Other Matters) Regulations 2025

The Lieutenant-Governor as the Governor's deputy, with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Surveillance Devices Regulations 2016—

(a)to further provide for certain IBAC Officers to be prescribed IBAC Officers for the purposes of the Surveillance Devices Act 1999; and

(b)to prescribe persons who may use body-worn cameras or tablet computers in the course of their duties and the circumstances in which the cameras or computers may be used for the purposes of the Surveillance Devices Act 1999; and

(c)to prescribe purposes for which local protected information obtained from the use of a body-worn camera or tablet computer by certain persons may be used, communicated or published; and

(d)to make other miscellaneous amendments.

2Authorising provision

These Regulations are made under section 37A of the Surveillance Devices Act 1999.

3Prescribed IBAC Officers

In regulation 7 of the Surveillance Devices Regulations 2016[1]—

(a)in paragraph (e), for "Specialists." substitute "Specialists;";

(b)after paragraph (e) insert

"(f)authorised officers within the meaning of the Independent Broad-based Anti-Corruption Commission Act 2011.".

4Prescribed persons and classes of persons and prescribed circumstances

In regulation 10(1) of the Surveillance Devices Regulations 2016—

(a)in paragraphs (e)(ii) and (f) , for "Department of Justice and Regulation" substitute "Department of Justice and Community Safety";

(b)in paragraph (g) omit "assigned to the Safety and Emergency Response Team of Youth Justice Division, Department of Justice and Regulation";

(c)paragraph (h) is revoked;

(d)in paragraph (s), for "Act." substitute "Act;";

(e)after paragraph (s) insert

"(t)an authorised officer within the meaning of the Independent
Broad-based Anti-corruption Commission Act 2011
in the circumstances of carrying out the authorised officer's functions under that Act or any other Act.".

5Prescribed purposes for the use, communication or publication of local protected information

(1)After regulation 11(1)(g) of the Surveillance Devices Regulations 2016 insert

"(ga)the performance of functions or duties or the exercise of powers by the IBAC under the Independent Broad-based Anti-corruption Commission Act 2011 or any other Act in relation to the investigation and prevention of corrupt conduct and police personnel misconduct, the collection and use of intelligence, the provision of education services and the compliance monitoring and oversight of Victoria Police;".

(2)After regulation 11(2)(a)(vii) of the Surveillance Devices Regulations 2016 insert

"(viii)the performance of functions or duties or the exercise of powers by the IBAC under the Independent Broad-based Anti-corruption Commission Act 2011 or any other Act in relation to the investigation and prevention of corrupt conduct and police personnel misconduct, the collection and use of intelligence, the provision of education services and the compliance monitoring and oversight of Victoria Police;".
