Regulations under the Surrogacy Act 2022

1Title

These Regulations may be cited as the Surrogacy Regulations 2022.

2Commencement

These Regulations commence on the day on which section 2 of the Surrogacy Act 2022 commences.

3Information for Registrar of Births, Deaths and Marriages

• (1)

  For section 46(2)(b) of the Act, the following information is prescribed:

  • (a)

    the maiden family name, if applicable, of each intended parent of the child;

  • (b)

    the date of birth, or age, and place of birth of each intended parent of the child;

  • (c)

    if the intended parents of the child are married – the date and place of marriage;

  • (d)

    the given names, sex or gender and date of birth of any other child (including a deceased child) of an intended parent and, if there are or were 2 intended parents, whether the child is or was of their relationship.

  Note for subregulation (1)

  This information is included in the notice given by a registrar of the Local Court to the Registrar of Births, Deaths and Marriages when giving a copy of a parentage order for registration under the Births, Deaths and Marriages Registration Act 1996.

• (2)

  For subregulation (1)(d), the sex or gender of the child may be recorded as male, female or unspecified.
