Regulations 1997

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to increase
the fees payable for certain things done by the

Sheriff.

2. Authorising provision

These Regulations are made under section 129 of the Supreme Court Act 1986.

3. Commencement

These Regulations come into operation on

1 November 1997.

4. New Table of fees inserted

For regulation 5 of the Supreme Court (Sheriff's
Fees) Regulations 19961 substitute—

"5. Fees

The fees payable for work performed by the
Sheriff are as set out in the following

Table—

TABLE

"No. Item Amount
1. (a) For execution or attempted execution of every $145.00

warrant or writ or other process (except for a warrant of possession, writ of possession or a combined warrant)

1. (b) For execution or attempted execution of every $180.00
warrant of possession or writ of possession, for
the first two attempts
1. (c) For execution or attempted execution of every $155.00

warrant of possession or writ of possession, after the first two attempts, for each 2 further attempts

1. (d) For execution or attempted execution of every $225.00
combined warrant
1. (e) For every warrant of possession or combined $90.00

achieved solely by means of the Registrar of

warrant where execution is requested to be interest in land.

2. Where a warrant, writ or other process for which $63.00

a fee is payable under item 1 specifies more than one address at which execution is requested, for each additional address specified

3. On the renewal of, or redirection of any warrant, $63.00
writ or other process or the receipt of instructions
to proceed with execution after the party at
whose request the warrant was issued has earlier
provided instructions to withhold or withdraw
from execution
4. For furnishing an office copy of a writ or warrant $28.00".
