The Supreme Court Rule Committee has made the following rules of court under the Supreme

Court Act 1970.

Explanatory note

The object of these Rules is to amend the Supreme Court Rules 1970 and the Criminal Appeal Rules consequent on the enactment of the Bail Act 2013 by removing certain rules and forms that are no longer necessary and updating references to the repealed Act.

1      Name of Rules

These Rules are the Supreme Court Rules (Amendment No 425) 2014.

2      Commencement

These Rules commence on the day on which they are published on the NSW
Legislation website.

3 Amendment of Criminal Appeal Rules

(1) Rule 5A Appeals under section 5AA of the Act

Omit “Bail Act 1978”. Insert instead “Bail Act 2013”.

(2) Bail
Omit the Part headed “Bail”.
(3) Rule 55 New trial
Omit “Bail Act 1978”. Insert instead “Bail Act 2013”.

4 Amendment of Supreme Court Rules 1970

(1) Part 75 Criminal proceedings

Omit rules 3E–3FB.

(2) Schedule F Forms
Omit Forms 74AF and 74AH.
