The Supreme Court Rule Committee has made the following rules of court under the

Supreme Court Act 1970.

Explanatory note
The object of these Rules is to amend the Supreme Court Rules 1970:

(a) to extend the publication requirements in rule 91 of Part 78 to a notice of intention to convey or distribute property of a deceased person under the Succession Act 2006 or Trustee Act 1925, and

1      Name of Rules

These Rules are the Supreme Court Rules (Amendment No 417) 2011.

2      Commencement

These Rules commence on the day on which they are published on the
NSW legislation website.

3 Amendment of Supreme Court Rules 1970

Part 78, rule 91

Omit the rule. Insert instead:

91      Notice of intended distribution

A notice under section 92 of the Probate Act, section 93 of the Succession Act or section 60 of the Trustee Act 1925 is to be published:

(a) if the deceased was resident at the date of his or her death in the State—in a newspaper circulating in the district where the deceased resided, or
