The Supreme Court Rule Committee made the following rules of court under the

Supreme Court Act 1970 on 21 October 2002.

Explanatory note

The object of these Rules is to amend the Supreme Court Rules 1970 to require an application for an order for the trial of proceedings with a jury made under section 85 of the Supreme Court Act 1970 (as inserted by Schedule 2 to the Courts Legislation Amendment (Civil Juries) Act 2001) to be made by notice of motion filed at the same time as the requisition for the jury.

Part 34 rule 3

Omit the rule. Insert instead:

3      Requisition for jury

(1)

An application for an order under section 85 of the Act for proceedings to be tried by jury must be made by notice of motion.

(2)

Any such notice of motion must be filed with the Court at the same time as the requisition for the trial with a jury referred to in section 85 (2) (a) (i) of the Act is filed with the Court.
