Supreme Court (Miscellaneous Amendments) Rules 2013

The Judges of the Supreme Court make the following Rules:

PART 1—PRELIMINARY

1Object

The object of these Rules is to amend—

(a)Rule 77.01 in Chapter I to replace a reference to the Associations Incorporation Act 1981 with a reference to its replacement, the Associations Incorporation Reform Act 2012;

(b)Rule 27.03(11)(b) in Chapter I, Rules 2A.03(2)(d) and 4A.03(2)(d) in Chapter III and Rule 2.04(1)(b) in Chapter VI to provide that a legal practitioner is required to provide an email address under these Rules.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 6 May 2013.

PART 2—AMENDMENT OF CHAPTER I

4Form of document

In Rule 27.03(11)(b) of the Supreme Court (General Civil Procedure) Rules 2005[1] omit "(if any)".

5Authority

For Rule 77.01(2)(a)(iii) of the Supreme Court (General Civil Procedure) Rules 2005 substitute

"(iii)sections 126 and 143 of the Associations Incorporation Reform Act 2012;".

PART 3—AMENDMENT OF CHAPTER III

6Notice of intention to apply

In the Supreme Court (Administration and Probate) Rules 2004[2]—

(a)in Rule 2A.03(2)(d) omit "(if any)";

(b)in Rule 4A.03(2)(d) omit "(if any)".

PART 4—AMENDMENT OF CHAPTER VI

7Legal practitioners

In Rule 2.04(1)(b) of the Supreme Court (Criminal Procedure) Rules 2008[3] omit "(if any)".
