Supreme Court (Hague Convention and Powers of Judicial Registrars Amendments) Rules 2019

The Judges of the Supreme Court make the following Rules:

Part 1—Preliminary

1Object

The object of these Rules is to amend Chapter I of the Rules of the Supreme Court—

(a)in relation to documents served in accordance with the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters; and

(b)to provide further powers for judicial registrars in relation to Part 6 of the Courts (Case Transfer) Act 1991 and Rule 41.01.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 3 June 2019.

Part 2—Amendments relating to Hague Convention—Order 80

4Note 3 in Part 1 of Order 80 substituted

In Part 1 of Order 80 of the Supreme Court (General Civil Procedure) Rules 2015[1], for Note 3 substitute

"Note 3

Information about the Hague Convention, including a copy of the Hague Convention, a list of all Contracting States, details of declarations and reservations made under the Hague Convention by each of those States and the names and addresses of the central and other authorities of each of those States, can be found at the website of the Hague Conference on Private International Law.".

5Form 80B amended

In Form 80B of the Supreme Court (General Civil Procedure) Rules 2015, for "[Central Authority/additional authority]:" substitute "[person to be served]:".

Part 3—Amendments relating to powers of judicial registrars

6Authority of judicial registrars

After Rule 84.02(3)(a)(vii) of the Supreme Court (General Civil Procedure) Rules 2015 insert

"(viii)Part 6 of the Courts (Case Transfer) Act 1991;

(ix)Rule 41.01;".

7Form 41D—Letter of request for examination of witness

In Form 41D of the Supreme Court (General Civil Procedure) Rules 2015—

(a)for "a Judge of the Supreme Court" substitute "*a Judge/*an Associate Judge/*a judicial registrar of the Supreme Court";

(b)at the end of the Form insert

"*delete if not applicable".
