Supreme Court (Chapters II and III Miscellaneous Amendments) Rules 2019

The Judges of the Supreme Court make the following Rules:

Part 1—Preliminary

1Objects

The objects of these Rules are—

(a)to amend Chapter II of the Rules of the Supreme Court in relation to commercial proceedings in a Commercial List that are managed by a Commercial List Judge, to require that an order of a Commercial List Judge be obtained before a default judgment may be entered; and

(b)to amend Chapter III of the Rules of the Supreme Court to increase the threshold for the exercise by the Registrar of Probates of powers of the Court under section 9 of the Wills Act 1997 in relation to informal wills.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 25 March 2019.

Part 2—Amendment of Chapter II

4Rule 2.07 substituted

For Rule 2.07 of the Supreme Court (Miscellaneous Civil Proceedings) Rules 2018[1] substitute

"2.07   Judgment in default and summary judgment

(1)Judgment in default of appearance or pleading shall not be entered in a proceeding in a Commercial List that is managed by a Commercial List Judge unless a Commercial List Judge so orders.

(2)Nothing in this Order shall prevent a party from applying under Order 22 or 23 of Chapter I or Part 4.4 of Chapter 4 of the Civil Procedure Act 2010.".

5Consequential amendment of Order 21 of Chapter I

(1)In Rule 21.01 of the Supreme Court (General Civil Procedure) Rules 2015[2]—

(a)in paragraph (2), after "Order" insert "unless Rule 2.07(1) of Chapter II applies";

(b)at the foot of paragraph (2) insert

"Note

Rule 2.07(1) of Chapter II provides that, in a Commercial List that is managed by a Commercial List Judge, an order of a Commercial List Judge is required before judgment in default of appearance can be entered.".

(2)In Rule 21.02 of the Supreme Court (General Civil Procedure) Rules 2015—

(a)in paragraph (1), after "Order" insert "unless Rule 2.07(1) of Chapter II applies";

(b)at the foot of paragraph (1) insert

"Note

Rule 2.07(1) of Chapter II provides that, in a Commercial List that is managed by a Commercial List Judge, an order of a Commercial List Judge is required before judgment in default of defence can be entered.".

Part 3—Amendment of Chapter III

6Registrar's powers

In Rule 2.09(b) of the Supreme Court (Administration and Probate) Rules 2014[3], for "$150 000" substitute "$1 000 000".
