Supreme Court (Chapters I, V and VI Amendments) Rules 2025

The Judges of the Supreme Court make the following Rules:

PART 1—PRELIMINARY

1Objects

The objects of these Rules are—

(a)to amend Chapter I and Chapter VI of the Rules of the Supreme Court in relation to the power of the Court to direct or order the Prothonotary, the Registrar of the Court of Appeal or the Judicial Registrar-Criminal Division to accept a document for filing and to make a statute law revision amendment to Chapter VI; and

(b)to further amend Chapter V of the Rules of the Supreme Court in relation to the powers of Associate Judges and judicial registrars in the Corporations List.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 31 March 2025.

PART 2—AMENDMENT OF CHAPTERS I AND VI

4Powers of Prothonotary or Registrar—Chapter I

For Rule 28A.04(5)(f) of the Supreme Court (General Civil Procedure) Rules 2015[1] substitute

"(f)if a direction is made under paragraph (d) or (e), make any consequential order or give any direction that it considers appropriate.".

5Powers of Registrar, Judicial Registrar-Criminal Division and Prothonotary—Chapter VI

For Rule 1A.04(4)(f) of the Supreme Court (Criminal Procedure) Rules 2017[2] substitute

"(f)if a direction is made under paragraph (d) or (e), make any consequential order or give any direction that it considers appropriate.".

6Statute law revision—Chapter VI

In Form 6–3DH of the Supreme Court (Criminal Procedure) Rules 2017 omit "at:".

PART 3—AMENDMENT OF CHAPTER V

7Amendment of Schedule 2—Powers of the Court that may be exercised by an Associate Judge

(1)After item 35 of Schedule 2 to the Supreme Court (Corporations) Rules 2023[3] insert

"35A s. 459T Wind up joint debtors in insolvency.".

(2)For item 40 of Schedule 2 to the Supreme Court (Corporations) Rules 2023 substitute

"40 s. 467 Exercise powers of Court on hearing winding up application.".

8Amendment of Schedule 4—Powers of the Court that may be exercised by judicial registrar

(1)After item 14 of Schedule 4 to the Supreme Court (Corporations) Rules 2023 insert

"14A s. 459T Wind up joint debtors in insolvency.".

(2)After item 17 of Schedule 4 to the Supreme Court (Corporations) Rules 2023 insert

"17A s. 467 Exercise powers of Court on hearing winding up application.".
