Supreme Court (Chapters I, IV and VI Further Amendment) Rules 2018

The Judges of the Supreme Court make the following Rules:

Part 1—Preliminary

1Object

The object of these Rules is to make further miscellaneous amendments to Chapters I, IV and VI of the Rules of the Supreme Court.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 22 October 2018.

Part 2—Amendment of Chapter I

4Service on particular defendants

For Rule 6.04(c) of the Supreme Court (General Civil Procedure) Rules 2015[1] substitute

"(c)a person under disability referred to in paragraph (b) of the definition of that term in Rule 15.01, on—

(i)the person who, in accordance with Rule 15.03(2), would be entitled to be litigation guardian in any proceeding to which that person under disability was party; or

(ii)if there is no such person, the person with whom that person under disability resides or in whose care that person is;".

5Rule 15.01 substituted

For Rule 15.01 of the Supreme Court (General Civil Procedure) Rules 2015 substitute

"15.01   Definition

In this Order, person under disability means—

(a)a minor; or

(b)a person who is incapable, by reason of injury, disease, senility, illness or physical or mental infirmity, of managing that person's affairs in relation to the proceeding.".

6Appointment of litigation guardian

(1)For Rule 15.03(2) of the Supreme Court (General Civil Procedure) Rules 2015 substitute

"(2)Where a person is authorised by or under any Act to conduct legal proceedings in the name of or on behalf of a person under disability referred to in paragraph (b) of the definition of that term in Rule 15.01, the person so authorised shall, unless the Court otherwise orders, be entitled to be litigation guardian of the person under disability in any proceeding to which that person's authority extends.".

(2)In Rule 15.03(3) of the Supreme Court (General Civil Procedure) Rules 2015, for "handicapped person" substitute "person under disability".

(3)In Rule 15.03(6)(b)(i) of the Supreme Court (General Civil Procedure) Rules 2015, for "minor or is a handicapped person" substitute "person under disability".

7Definitions—Order 79

In Rule 79.01 of the Supreme Court (General Civil Procedure) Rules 2015, the definition of handicapped person is revoked.

8Authority

In Rule 79.12 of the Supreme Court (General Civil Procedure) Rules 2015, for "handicapped person" substitute "person who is incapable, by reason of injury, disease, senility, illness or physical or mental infirmity, of managing that person's affairs".

Part 3—Amendment of Chapter IV

9Application to discharge adoption order—Form 11

In Rule 31(3) of the Supreme Court (Adoption) Rules 2015[2], for "A summons" substitute "Unless the Court otherwise orders, a summons".

Part 4—Amendment of Chapter VI

10Limitations on authority of judicial registrar

Rule 4.16(a) of the Supreme Court (Criminal Procedure) Rules 2017[3] is revoked.

11Statute law revision—Form 6–12Y

In Form 6–12Y of the Supreme Court (Criminal Procedure) Rules 2017, for "20018" substitute "2018".
