Supreme Court (Chapters I and V and Library Amendments) Rules 2023
The Judges of the Supreme Court make the following Rules:
PART 1—PRELIMINARY
1Objects
The objects of these Rules are—
(a)to amend the Supreme Court Library Rules 2019 to provide for 2-year terms for Supreme Court Library Committee members who are local legal practitioners; and
(b)to amend Order 79 of Chapter I of the Rules of the Supreme Court as a consequence of the enactment of the Victims of Crime (Financial Assistance Scheme) Act 2022; and
(c)to amend Chapter V of the Rules of the Supreme Court to include an additional power under the Corporations Act to be exercisable by an Associate Judge or a judicial registrar.
2Authorising provisions
These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.
3Commencement
These Rules come into operation on 1 September 2023.
PART 2—AMENDMENT OF SUPREME COURT LIBRARY RULES 2019
4Composition of Committee
(1)For Rule 7(1)(c) of the Supreme Court Library Rules 2019[1] substitute—
"(c)four local legal practitioners who shall be appointed by the Council of Judges for a period of two years.".
(2)In Rule 7(2) of the Supreme Court Library Rules 2019, for "Council of the Law Institute" substitute "Board of the Law Institute".
(3)In Rule 7(3) of the Supreme Court Library Rules 2019 omit "occurring during the year".
PART 3—AMENDMENT OF CHAPTER I
5Application of money
After Rule 79.02(1)(d) of the Supreme Court (General Civil Procedure) Rules 2015[2] insert—
"(da)section 70(2) of the Victims of Crime (Financial Assistance Scheme) Act 2022; or".
PART 4—AMENDMENT OF CHAPTER V
6Schedule 2 amended
(1)In Schedule 2 to the Supreme Court (Corporations) Rules 2023[3], after item 30 insert—
| "30A | s. 459A | To order that an insolvent company be wound up in insolvency.". |
(2)Item 37 of Schedule 2 to the Supreme Court (Corporations) Rules 2023 is revoked.
7Schedule 4 amended
(1)In Schedule 4 to the Supreme Court (Corporations) Rules 2023, after item 9 insert—
| "9A | s. 459A | To order that an insolvent company be wound up in insolvency.". |
(2)Item 16 of Schedule 4 to the Supreme Court (Corporations) Rules 2023 is revoked.
