Supreme Court (Chapter VI Judicial Registrar Powers Amendment) Rules 2025

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Chapter VI of the Rules of the Supreme Court to provide for powers of judicial registrars in the Supreme Court under Division 3A of Part 5.5 of the Criminal Procedure Act 2009 following the committal of an accused person to stand trial, as a consequence of the enactment of the Justice Legislation Amendment (Committals) Act 2025.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 28 December 2025.

4Principal Rules

In these Rules, the Supreme Court (Criminal Procedure) Rules 2017[1] are called the Principal Rules.

5New Rule 4.15.1

After Rule 4.15 of the Principal Rules insert

"

4.15.1   Pre-trial taking of evidence and


cross-examination

(1)Without limiting any other powers of a judicial registrar, a judicial registrar may, subject to this Order, conduct the pre-trial taking of evidence and cross-examination hearings under Division 3A of Part 5.5 of the Criminal Procedure Act 2009.

(2)Subject to this Order, a judicial registrar may exercise the powers of the Court under sections 198, 198A and 198B of the Criminal Procedure Act 2009.".

6Limitations on authority of judicial registrar

Rule 4.16(b) of the Principal Rules is revoked.
