Supreme Court (Chapter V Amendment No. 4) Rules 2007

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Chapter V of the Rules of the Supreme Court to allow an entity to quote its ABN (Australian Business Number) instead of its ACN or ARBN on documents, consistent with recent changes made to the Corporations Regulations 2001 of the Commonwealth.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986, section 23 of the Corporations (Ancillary Provisions) Act 2001 and all other enabling powers.

3Commencement

These Rules come into operation on 1 October 2007.

4Amendments relating to ABNs

(1)In the note to Rule 1.4 of the Supreme Court (Corporations) Rules 2003[1], before "ACN" insert—

"ABN (short for 'Australian Business Number')—see section 9;".

(2)In Schedule 1 to the Supreme Court (Corporations) Rules 2003—

(a)in Form 1, for "ACN or ARBN: [insert ACN or ARBN]" substitute "ABN or ACN or ARBN: [insert ABN or ACN or ARBN]";

(b)in Form 9, for "ACN:  [ACN of company to which proceeding relates]" substitute

"ABN or ACN:  [ABN or ACN of company to which proceeding relates]";

(c)in Form 10, for "ACN:  [ACN of company to which proceeding relates]" substitute

"ABN or ACN:  [ABN or ACN of company to which proceeding relates]";

(d)in Form 11, for "ACN:  [ACN of company to which proceeding relates]" substitute

"ABN or ACN:  [ABN or ACN of company to which proceeding relates]";

(e)in Form 12, for "ACN:  [ACN of company to which proceeding relates]" substitute

"ABN or ACN:  [ABN or ACN of company to which proceeding relates]";

(f)in Form 15, for "ACN:  [ACN of company to which proceeding relates]" substitute

"ABN or ACN:  [ABN or ACN of company to which proceeding relates]";

(g)in Form 16, for "ACN:  [ACN of company to which proceeding relates]" substitute

"ABN or ACN:  [ABN or ACN of company to which proceeding relates]".
