Rules 2000

The Judges of the Supreme Court make the following Rules:

1. Object

The object of these Rules is to amend the for the rectification of wills.

2. Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986, the Administration and Probate Act 1958 and all other enabling powers.

3. Commencement

These Rules come into operation on

1 October 2000.

4. Principal Rules

In these Rules, Chapter III of the Rules of the Supreme Court1 is called the Principal Rules.

5. New Order 12 inserted

After Rule 11.02 of the Principal Rules insert—

"ORDER 12—RECTIFICATION

12.01 Application of Order

This Order applies to an application,
pursuant to section 31 of the Wills Act 1997,
for rectification of a will.

12.02 Process

(1) An application for an order under section

31(1) of the Wills Act 1997 shall be made
by summons filed in the proceeding in which

the grant of representation was made.

(2) The application shall be supported by an

affidavit setting out the facts upon which the applicant relies to show that the will does not carry out the testator's intentions either
because of a clerical error or because the will
does not give effect to the testator's

instructions.".
