Supreme Court (Chapter II Supreme Court Roll Amendment) Rules 2023
The Judges of the Supreme Court make the following Rules:
1Object
The object of these Rules is to amend Order 14 of Chapter II of the Rules of the Supreme Court in relation to the change of name of a person on the Supreme Court roll.
2Authorising provisions
These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.
3Commencement
These Rules come into operation on 1 June 2023.
4New Rules 14.14 and 14.15 inserted
After Rule 14.13 of the Supreme Court (Miscellaneous Civil Proceedings) Rules 2018[1] insert—
"14.14 Application for change of name on the Supreme Court roll
(1)A lawyer whose name is on the Supreme Court roll may apply to the Court for the lawyer's name to be changed on the Supreme Court roll.
(2)The application shall—
(a)be in Form 2–14A; and
(b)be accompanied by an affidavit in support setting out the reasons for the change of name and exhibiting any relevant supporting documentation.
14.15Court may order Prothonotary to change name on Supreme Court roll
(1)On an application under Rule 14.14, the Court, if satisfied that it is appropriate to do so, may order that the Prothonotary change the name of the lawyer on the Supreme Court roll to the name requested by the applicant.
(2)No appearance or contradictor is required on the hearing of an application under Rule 14.14.".
5New Form 2–14A inserted
After Form 2–14 of the Supreme Court (Miscellaneous Civil Proceedings) Rules 2018 insert—
"Form 2–14A—Application for change of name on Supreme Court roll
Rule 14.14(2)
IN THE SUPREME COURT OF VICTORIA
AT
IN THE MATTER OF:
APPLICATION FOR CHANGE OF NAME ON SUPREME COURT ROLL
TO the Prothonotary:
I wish to apply for an order that the Prothonotary change my name on the Supreme Court roll to: [insert new name]
