Supreme Court (Chapter II Amendment No. 7) Rules 2007

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Order 17 of Chapter II of the Rules of the Supreme Court as a consequence of the enactment of the Wills Amendment Act 2007.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 3 September 2007.

4Want of testamentary capacity

For Rule 17.05(2)(b) of the Supreme Court (Miscellaneous Civil Proceedings) Rules 1998[1] substitute

"(b)the proposed will or revocation reflects what the intentions of the person would be likely to be, or what the intentions of the person might reasonably be expected to be, if he or she had testamentary capacity;".
